Relaxation of the law of urban leasing in Marbella
20 May 2014 | News and UpdatesWith the new law 4/2013, of June 4, 2013, of measures of easing measures and promotion of rental housing market, four important points have been introduced has like fundamental objective, the relaxation of the law of urban leasing in Marbella and in Spain.
Let’s review below in a generic way the most relevant points:
- The legal regime, strengthening freedom of covenants and prioritizing will of the parties.
- The duration of the lease, reduced from five to three years and mandatory extension from three to one tacit renewal, in order to boost the rental market and give it greater flexibility. Thus, landlords and tenants can more easily adapt to any changes in your personal circumstances
- The recovery of the property by the lessor, to be earmarked for permanent housing in certain cases, had passed requiring at least the first year of life of the contract, without express provision therein, providing greater flexibility to lease
- The provision that the lessee can cancel the contract at any time after the expiry of at least six months and provide the landlord with a minimum of thirty days. It recognizes the possibility that the parties may agree to compensation for cancellation.
